I recently came across an estate agent (not one in Falmouth) who was selling his clients’ house for £260,000 and had tried to persuade them and the buyer to enter into an arrangement where £260,000 would be paid on completion of the purchase but the price would be stated at £250,000, which meant that the lower rate of Stamp Duty Land Tax would be paid i.e. one per cent rather than the higher rate of three per cent, writes solicitor and property lawyer Henry Preston.
