The son of a car repair business owner in Devoran has been banned from driving for four years, after being found nearly four times the legal limit for alcohol.

Elliot Jon Osborne, aged 36, of Halbullock View, Gloweth, pleaded guilty at Truro Magistrates’ Court to drink driving on July 26 when he registered 123 mcg in breath – the legal limit being 35mcg. He had a previous similar conviction in 2009.

Paul Simons, his solicitor, said the previous day Osborne had been on a bender with a friend, drinking all day. He carried on drinking when he got home by taxi, and then slept. When he awoke he felt OK to drive.

However, he registered nearly four times the legal limit when police officers spoke to him in Moorfield Car Park, Truro, after a report from a filling station cashier that he might be under the influence of alcohol.

Osborne, the son of the proprietor of a car repairs business in Devoran, was in the process of taking over the business from his father.

He knew he had a drink problem and was trying to deal with it.

Osborne was given an 11 week prison sentence suspended for two years, put under curfew three nights a week for 12 weeks, told to pay costs and surcharge of £165 and banned from driving for 48 months.
