The secretary of a company whose lorry was involved in a horror crash which left a Falmouth mother in hospital for months has applied to have his case dismissed.

Gavin Morris Bentley, 39, of Cannock in Staffordshire, is the company secretary of Midland Poling Services and was charged with aiding or abetting the causing of injury by dangerous driving.

On Friday morning his solicitor told a hearing at Truro Crown Court that he had submitted an application for dismissal as the crime "cannot be proved."

A date was set for a dismissal hearing, which will be held at the court on June 30, and which Bentley, who was granted unconditional bail, is not required to attend.

The driver of the van, Paul Christopher Ince, 46, of Leyland in Lancashire, was originally expected to also appear in Court on Friday, but the date for a plea and trial preparation hearing was moved to June 22.
