A young cyclist who received life-threatening injuries in a road accident at Probus earlier this year is still waiting for a court to hear the case against a motorist accused of careless driving.
The incident took place in June after which a motorist on holiday here from his home in Pretoria, South Africa, was charged and summoned to appear in court.
Since then Truro magistrates have been told more than once that he is unfit to travel because of ill health, and this week heard from counsel Nigel Hall that Heinrich Kruger, now aged 84, had heart and other problems which meant he could not journey to the UK for the trial, although he wanted to.
His suggestion that Kruger should give evidence through video link was deemed to be illegal according to legal advisor Paul Miles, and the magistrates agreed to put the case off for a further month for review.
