There were 17 instances of ‘dogging’ reported to Devon and Cornwall Police  in 2018 – five of which were on the A30 near Launceston.

A Freedom of Information Request asked Devon and Cornwall Police to provide a list of reported incidents of dogging, or people engaging in sexual acts in a public or semi-public place or watching others doing so.

The response from the Force said that in 2018, there were 17 offences recorded under the offences of the Act of Outraging Public Decency – Common Law or Conspire To Outrage Public Decency.

In 12 of the 17 instances, the crime was investigated as far as reasonably possible with no suspect identified, the response from the police stated.

One incident saw the police decide that formal action against the offender was not in the public interest. Three incidents saw a named suspect identified but that there was ‘evidential difficulties’ against them. The final incident remained under investigation as of the date when the FOI was submitted.

The response outlined that the A30 near Launceston in Cornwall was the location for five of the separate incidents.

The offences included a male and female seen performing oral sex in a churchyard in Torquay, a man and a woman having sex on the street in Exeter, and two males being found engaged in a sexual act in a layby at the A30 near Launceston,

The offences came under the criminal offences of the act of outraging public decency, which says that the act was of such a lewd character as to outrage public decency and the act took place in a public place and must have been capable of being seen by two or more persons who were actually present, even if they did not actually see it.

Although the practice of dogging is not explicitly banned by one particular law, there are a multitude of offences anyone one caught doing the dirty in public could be charged with.

These include anything from indecent exposure, public lewdness and gross indecency, to name a few.

People caught dogging could be prosecuted under the Sexual Offences Act 2003 or under the common law offence of outraging public decency.
