Falmouth's police sergeant said there are "no lines of enquiry" after vandals painted out a new yellow line in a Castle Drive layby popular with people living in their vans.

Town councillor Bob O'Shea raised the issue at the last Falmouth Town Council meeting, but the sergeant responded by saying it was not a police matter.

Since then, Cornwall Council has said it is "currently co-ordinating the re-marking of the lines to make the lay-by restrictions enforceable in due course."

The yellow line was painted recently after the town's parking review which saw work completed in October last year.

A waiting restriction prohibiting people from parking in the layby between midnight and 6am was put in place.

The line has been painted over for some months now, with no action yet taken by the council.

A council spokesperson said that the line was painted over by an "unknown third party".

At the council meeting, sergeant Paul Kelly said: "Whether there are yellow lines there is not a police issue. If we have got no lines of enquiry then we cannot investigate.

"The only reason the police would be involved would be to do with any criminal activity. We can't act outside our jurisdiction."

A council spokesperson said: "Following the town parking review for Falmouth, a limited waiting restriction of no waiting midnight – 6am was put out to statutory and public consultation and following the consultation the recommendation was to proceed with the advertised restrictions.

"The yellow line road markings were laid recently, then were painted over by an unknown third party. We are currently coordinating the re-marking of the lines to make the lay-by restrictions enforceable in due course."
