A driver charged with causing the death of a 62 year-old Falmouth man has had his case sent to crown court this morning.

Jaroslaw Bakula, 35, of Long Cross, Bristol, appeared at Bodmin magistrates court this morning after allegedly causing the death of 62-year-old Mr West on July 13, 2020.

The full charge reads that on July 13, 2020 at Liskeard in the county of Cornwall he caused the death of Steven West by driving a mechanically propelled vehicle, namely a Mercedes Sprinter van, dangerously on a road namely the A38 at Two Waters Foot contrary to section one of the Road Traffic Act 1988 and Schedule 2 to the Road Traffic Offenders Act 1988.

During the hearing, Bakula was told by magistrates that: "This offences is indictable only, which means it is outside of the sentencing powers of this court.

"Therefore, this matter must be sent to the crown court."

The court also heard how Bakula was a Polish national who is currently living and residing in the UK and had no previous convictions.

No plea was entered during proceedings.

Magistrates told Bakula that his crown court hearing would take place on May 27 at 10am and that he had been granted bail with conditions.

They also told the defendant: "If you do not come back to court at that date and time, you may commit and offence.

"You could be arrested, fined, or sent to prison.

"If you commit a crime whilst on bail your sentence will be greater."

Bakula was told he must reside, live and sleep at his address in Bristol.

Magistrates also told Bakula: "These conditions are necessary because of the seriousness of the offence and to make sure you attend court."

In the original report of the accident police said they were called to a three-vehicle crash at around 3.45pm on Monday, July 13 on the A38 Glynn Valley, near Two Waters Foot.

The vehicles involved were a white Mercedes-Benz Sprinter van, a white Citroen Relay van and a silver Ford Mondeo.

The driver of the Mondeo, 62-year-old Mr West from Falmouth, was pronounced deceased at the scene, police said.

The other occupants of the vehicles sustained minor injuries.
