A TEENAGER from Truro has avoided jail despite committing an offence while on a suspended sentence.

Eloise Lauren Pain, aged 18, of a pod at New County Hall in Truro, appeared in front of magistrates at Truro Magistrates' Court on Monday, October 10 on one count of being drunk and disorderly in a public place and one count of committing an offence while during the operational period of a suspended sentence.

The offence took place in Newquay on Friday, September 16 where Pain was found to be drunk and disorderly in a public place, namely outside Tai Sing Chinese restaurant and the street outside, Station Approach.

Pain had been on a suspended sentence for a previous offence of possession of a bladed article. 

She pleaded guilty to the offence and admitted the breach of her suspended sentence.

During her sentencing, Pain who had already been handed down a prison term of four months suspended for 24 months, was given an additional six months added on to her original suspended sentence, bringing it to a total period of 24 months. 

For the offence of being drunk and disorderly, she was discharged conditionally for 12 months and will also have to pay a surcharge to fund victim services of £24 as well as costs of £85 to the Crown Prosecution Service.

Pain will also be under an electronically monitored curfew between the hours of 5pm and 7am for four weeks and will also need to take part in a rehabilitation activity for a maximum period of ten days. 

The court noted how Pain's guilty pleas had been taken into account when imposing the sentence.
