A PENRYN woman who was found to be in possession of over 18 grams of Class A and B drugs has been sentenced by a court in Cornwall.
Holly Gothe, aged 29, of Penryn, appeared at Truro Magistrates' Court on Monday, December 18, 2023, on one count of possession of a controlled drug of Class A, namely cocaine, and one count of possession of a controlled drug of Class B, namely amphetamine.
The first offence took place on Sunday, June 12, 2022, in Falmouth where Gothe was found to be in possession of 11.5 grams of amphetamine. Then, on Wednesday, August 10, 2022, Gothe was found to be in possession of 6.51 grams of cocaine.
Gothe indicated a plea of guilty to both offences.
During her sentencing, Gothe was made the subject of a community order under which she must take part in a rehabilitation activity for a maximum period of 10 days.
Gothe was also made to pay costs of £85 to the Crown Prosecution Service as well as pay a surcharge of £114.
Both quantities of drugs were forfeited for destruction and the court also noted that Gothe's guilty pleas had been taken into account when imposing the sentence.
According to the Sentencing Council, the penalty for possession of controlled drugs depends on the class and quantity of the drug, and where the person and the drugs were found.
The maximum sentence for possession of Class A drugs is seven years’ custody, an unlimited fine, or both. The maximum sentence for possession of Class B drugs is five years’ custody, an unlimited fine, or both.
